    So nice to still have some daylight at 5oclock:TAm just off to the postbox to walk off my tasty whoopsied roast dinner I have had as I have been in all day and need to stretch my legs;)also I want to post my D grandson' letter(which i have been doing since he went to Uni on a weekly basis) a Nannylala thing:)

    Good afternoon everyone.

    A flying visit from me today, thanks for the all the cyber hugs that Dodo delivered today. We had a lovely breakfast and chat. :A

    I'm sorry not been around for few days, mum deteriorating, not sure how long she has could be weeks but possibly months. Not good yesterday as one of her arms has decided not to do as it is told. Fine before she had a long sleep but when she woke up she could not move it, I thought I would go in today and find it in working order again but not to be. Also chest infection getting worst. She had been more comfortable pain wise but that has suddenly escalated again so new meds increased again, but had to be sedated as it was too much for her. :(

    Have no idea what I should be looking out for at any of the supermarkets at the moment but did notice today in Sainsbobs, lots of Olay and Garnier products 70% off and Sure, Garnier and Soft and Gentle deoderants reduced to around 50p so got a few to get back the money from my parking while having breakfast. ;)

    First time today I have been shopping since saturday for M & S party food for mum's 80th last Saturday, she did have a lovely day and did a little speech to thank us all for coming. Bless her. :)

    Hope the night crew are behaving, Claire, David., DM, Artha and Funky, missing you all. :A:A:A

    I earn my bread and butter writing employment contracts and can confirm you are only entitled to a break if you work more than 6 hours. It is certainly illegal for a company to employ someone without issuing a contract of employment, but it happens more often than you may think.

    The business about you having to produce written contacts to be taken by the interim company is rubbish. The company that you used to work for will be transferring you to the new employer (TUPE regulations apply). The new employer can then choose to vary your terms (less hours, different holidays etc). You can either sign the new contract offered or leave.

    Are there a few of you in the same situation, with no written contract?

    The aspect I would be looking at is the legal definition of an employee whether you have a written contract or not;

    is there a personal file for you with a written job offer in it - if yes then you are an employee
    are you paid electronically directly from the company to you (not via an agency) - if yes then you are probably an employee
    do you have wage slips with the employers name on - if yes then you are probably an employee
    can you choose what work you do there and/or what hours you work - if no then probably an employee
    are you subject to the same terms and conditions as someone with a written contract? - if yes then probably an employee.

    I would get back in there and make it clear that you were an employee of the original company who broke the law by not giving you a written contract, show payslips etc and quote TUPE at them. Under TUPE it is not up to you to prove that you worked for them. Do it politely but firmly, then start looking for a new job or hope this company really is just interim and you end up with a better employer.

    Sorry Izzey but up to 6 hours gets no legal entitlement to a break. Companies that want to work to the letter of the law can even get you to work 12 hours with just a 20 min break as it is not even cumulative (6 hours =20 mins, 12 hours = 40 mins etc)

    Had 'half way' chemo this morning :j then met my manager to sort out officially returning from maternity leave and moving onto sick pay as of April.
