child disability premium on income support

help we have been told by the dhss that we will not be getting back dated payments of child disability premium on income support my son as been on this benifit from 2006 and thay have just told us we should of been getting child disability premium on income support from that date.
the reason thay say is we did not inform them he had been awarded disability benifits so haw could thay pay us
but we did ring them and let them know but i have no proof as it we by phone i just told the dhss all this and thay just sed if you rang up it would be a call centre not the dhss and we should of informed them but when you ring up and need anssers about your benifits thats the number you ring and all this as just know come to light and he as been on the benifit from 2006 and is still on it thay sed we can appeal but we canot prove we rang them all the way back in 2006 so the will get away with all my sons money

    You can appeal however it will be your word against their computer records showing no call logged. I take it you no longer have your phone bills (or have no way of getting these)?

    Ultimately a tribunal judge will make their decision on the balance of probabilities and it is not unheard of for DWP not to log calls made especially as it sounds as though you have an old ruled IS case and the contact centre adviser may not have been familiar with how these cases work.

    As it stands I would appeal as you have nothing to lose and everything to gain. However a judge will ask why have you not been chasing the DWP non-stop since 2006?

    Has JCP added the premium now?

    yes thay have put it on this week
    but as i tryed to tell them we where never told about this part of the benefit and it only came to light as the dhss have had there systems changed it was only then thay told us about the child disability premium we should of been getting
    i will appeal but i not hold out much hope as thay where very of hand on the phone theres not a lot a places you can go to for advice when you are dealing with the dhss

    it is very unfair, but the onus is always on the claimant to find out what they are entitled to, and not on the DWP to track down people that may not be receiving their full entitlement
