Yes he would get the same for 6 months but after that his IB will be paid at higher rate. Anyway he could win the lottery tomorrow and no longer be entitled to Income Support but at least his IB would continue!
Social Services dept has a duty to carry out an assessment under s47 of the Community Care Act within a reasonable timescale. They also have to provide any services such as aids and adaptations which they then identify - again within a reasonable timescale. My colleague deals with these issues on a daily basis so I do have some knowledge of it. Perhaps you should instruct a firm of solicitors to pursue this for you. Your son should be eligible for legal aid for this even though you are acting on his behalf.
There are very few who specialise in Community Care law but I'd check out https://www.clsdirect.org.uk for some info. If there are none in your area you should ring CLS (Community Legal Service) on a weekday and they'll point you in the right direction. The few that are out there can have their legal aid contract covering a larger area then normal due to the scarcity.I'll get you, my pretty, and your little dog too!0
