The alternative is to get the CB and child tax credits transferred to her name (if that is a possibility)
Or could the child share with you child or could you make some alternative arrangements when she stays.
Well she pays for a 2 bedroom place now, but after everything has been paid for she has nothing left. If we move in together she'll save 50% a month on what she's paying now anyway as it will be split.
She has put in a claim to get the benefits off her ex which is being processed. Hopefully the outcome will be favourable for her. What basically happened is that he had an affair with her sister for x amount of years. When she found out she had a breakdown and went into hospital for a while. When she was in hospital he got the benefits changed over to him and has lived off them ever since. She is now recovered works full-time and is literally on the breadline through no fault of her own. I asked her if she ever gave permission for him to take them. She said no but was hospitalised and can't really remember and i guess because of her situation the CB agreed to move them to him even though his actions caused her to end up there..!0 -

I guess that will depend if the living room etc are being shared
Single people over 35 and couples without children including joint tenants
The LHA rate is actually based on the number of bedrooms that are needed, not the size of the property occupied. The exception to this is where a single claimant or couple has only one room of their own and shares the living room, kitchen and bathroom with others. In this situation the tenant’s Housing Benefit would be calculated using the shared room rate of Local Housing Allowance.0 -
She will be classed as a single person for HB and, as such, will only qualify for the shared accommodation rate to be used in the HB calculations
Unless she is over 35 in which case she will qualify for the one bedroom rate.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0
