Claiming money back after fraud

in Credit cards
Hi all,
Around eighteen months ago when I was on holiday in the US my American Express card was copied and used fraudulently. So after a few days back in the Uk I realised my card was being used fraudulently in the US and called American Express to inform them of the fraudulent activity. American Express informed to pay back the money that occured from the fraud and to claim it back. So six months later an individual was successfully prosecuted for credit card fraud and sent to prison. Despite this I have have to yet to receive the compensation back from the fraud a year later. Can you offer me advice you to get my money back as soon as possible.
Kind Regards
Michael

I'd be giving them a call. You should have been given the money back straight away.0 -
I too have been a victim of fraud this week.reclusive46 wrote: »I'd be giving them a call. You should have been given the money back straight away.
Vanquis told me they couldn't refund the money until the fraud had been investigated on my account.they said if I didn't pay it off when statement is done I would have interest added which I could claim bsck. Now, my concern is that if I don't pay in full the following months transactions will not be interest free so will I get that interest back as well? There is no way I can afford to pay the extra fraudulent amount (who can) so this is all I can do and hope I get all interest charges back.0 -
A credit card statement is simply the banks view of an account at a point in time i.e. what the bank thinks you owe it (or it owes you).
If you didn't make the transactions, then you are not liable for them. If the bank wants to add interest to transactions you didn't make, then good for them but you are still not liable for the transactions or any additional charges as a result of those transactions. Nearly all charges are automatically added so until a 'real' person knows about them - the bank just goes through the motions and continues to add them.
Call the bank, tell them you don't agree with the statement; that there has been fraudulent activity on the account and let them sort it out. It's up to them to either accuse you of fraud (you made the purchases and lied, gave away your PIN etc) or to remove the fraudulent charges and any other additional charges based on those transactions.
The bank won't do anything unless you tell them.0 -
I have already and it'd going through the system. Hope I get those charges back as I budget everything and so this would be a big blow to that.0

Michael - what 'compensation' are you expecting? Is this over and above the reversal of the fraudulent transactions?
If so, you are not entitled to anything - as their only obligation is not to charge you amounts you did not legitimately incur.0 -

Not so sure...
Do you mean they refunded the fraudlent transactions.Michael_Stevens wrote: »So six months later an individual was successfully prosecuted for credit card fraud and sent to prison.
Now back track.
What type of fraud was this. Cloned card does not require you to even know this...
In fact we never tell anyone this, even if we find out.
So you have now set me wondering just what type of fraud was this....
Did you still have your card, when the fraud was reported.Michael_Stevens wrote: »

Not sure what you mean by compensation. Fraud is a fact of life. So long as you got the transactions refunded and was not charged any interest or late fee's. Due to the fraud.
Then it was all resolved months ago.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
Thaks for your advice so far, when I said compensation I meant that money I had used to cover the bill after the fraudulent activity. So I meant refund. I reported the fraud straight away in June 2011 and at the time American Express paused all transactions on the card for week a month later the fraudster used a copy of my card again in the US while I was in the UK. Then after this I got replacement credit card. Regarding why I think it's clone card it is because I never lost my credit card and all the transactions occured in person. So the reason I posted this thread is despite it being a year and half later I have to receive a refund,so the question is how much longer do I to wait and is there any concrete steps I can take to hurry the process because presently I'm in limbo.0

Are you saying you paid a bill with fraudelant items on it?
If so you should have been refunded almost immediately - did they send you a declaration to sign at all? - Did you return it??
I would chase this up immediately.0 -
Yes I paid my bill which covered fraudulent items because American Express said they would refund the costs. I keep calling American Express with the hope of resolving the situation however all they do is tell me to wait. Is there any laws or legal avenues I can go down which can help me resolve this matter quickly.
P.s. I have contacted the financial ombudsman.0 -
FOS should resolve this if it goes to them.
I would expect AE to refund as soon as you mention them.
Is this a charge card or a credit card?Never ASSUME anything its makes a>>> A55 of U & ME <<<0
