I've rec'd a Legal Action Pending/Charge Notice quoting "Protection of Freedoms Act 1st Oct 2012" can they legally persue the company/driver for the "parking" charge, or as with other/older forums totally ignore or does this Act change things?

Provided they are a BPA AOS member, and that they have followed all the requirements of Schedule 4 of the POFA, then they can pursue the RK for any charges that the driver would have been liable for.
The last part of this sentence is the key here though. For an unenforceable speculative invoice for a contractual penalty (which is what these tickets are) then legally, the driver wouldn't have been liable for anything in the first place - not for the sums of money they traditionally seek.
Therefore although they may be able to pursue the RK in place of the driver, the sums they seek are still unenforceable contract penalties. There are also arguments over whether the PPC has sufficient ownership or occupational rights to form a contract in the first place, as per the recent VCS v HMRC court ruling.Je Suis Cecil.0 -

i have also rec'd a letter from TPS (Total parking solutions) and very bamboozled of their legal words!!
is it safe to ignore?
should contact them?

I am now dealing with TPS. I have asked for the POPLA code from them, but now I will ignore them. Good luck to The Greek, you are not alone. If they bombard me with harrassing debt letters I will send the missus in to scream at the manager of the shop with the letters in hand(It will give me a break lol)0
