revolking no claim and fault on insurance?

Hi everyone,

I’m after some advice. I was in a car accident 3 years ago and have finally come to court the their party didn’t turn up / paperwork was sent to Belgium! and are now awaiting a settlement. ( only reason it gone to court as other party’s solicitors hadn’t responded, they said they’re weren’t aware of court date anyway this cleared up now)

The accident was between foreign lorry diver who hit us and made us clip the girl in front who for what ever reason saw the lorry come into us and slammed on her breaks , we think he was close to the back of her when he moved over. Our insurance company have been awful RAC, anyway they said as we hit her we were at fault and as a result our insurance premium doubled and i lost my no claims, 3 years have now passed and as mentioned it gone to court, I just happened to mention to my barrister that we only wanted what we lost out on having to pay extra insurance and excess and a couple of days off, and she said that he had admitted full liability of the accident so we should have been classed as fault and this is incorrect, Has anyone else had this before can I get my non claims back and if he’s admitted liability can I get the fault removed? I’ve since changed insurance company as Rac ever awful and get trying to con us into admitting it was our fault, the police even said into their reports we helped avoid a major incident and wasn’t our fault. Apparently insurance companies don’t like to get involved and look for an easy get out. We paid for legal services but haven’t had any help form them and hired our own solicitor to sort the situation, and no its not a no win no fee company J not that their nothing wrong with them J just wasn’t after compensation for injury’s just my expenditure and cost of hiring a car.

    Your fault claim will remain until your insurer gets fully reimbursed their outlay over your claim from the third party.

    Once they are repaid in full your no claim bonus should be reinstated.
