HMV won't refund and manufacturer won't exchange

Hi

My friend purchased a tablet for her son for Christmas from HMV, and on opening it up it didn't work. She has been in to the store who have refused to refund saying she has to claim under the manufacturers warranty. The manufacturers are refusing to exchange saying the store should refund or exchange. What are my friends rights? I'm not sure whether she paid on a credit card or not, and she can't afford to buy her son a replacement.

    Currently HMV are still under administration so they wont refund or exchange. get you friend to explain this to the manufacturer

    And the manufacturer probably hasn't been paid for the product by HMV before it went under.

    OP how did you pay for the item?

    HMV are in administration, so she has no rights against them.

    Her bank may help, but it won't be a very quick process. Obviously this only applies if she paid via credit card and it was over £100..

    a very valid point above - if the manufacturer wasn't paid, your friend is in for a tough and probably fruitless battle.

    Most likely.

    I am in a simlar boat with a freeview tv recorder from comet.

    It is a ferguson which was under licence to comet, so no UK repair service. 4 month old and stopped working ( no power) checked comet site set up by administratore and told with ferguson i have to get it repaired privately and then submit the repair invoice to admins to be added to unsecured creditor list which means i will get peanuts back in about 4 yrs time if i am lucky

    As sad as this is, from now on people, please avoid buying electrical items from shops in difficulty unless you're spending more than £100 on a credit card. Both HMV and Comet were giving off signs a mile off. Now it's Staples that should really be avoided.

    As above though, your rights were with HMV, and as they no longer exist in the same form as when the tablet was purchased, there isn't much that can be done!

    I've absolutely no evidence on their financial state, but personally I'd be avoiding Maplin as well, over-priced, poor customer service and always empty whenever I pass a branch. The sort of trigger signs I usually look for.

    I visited the Newcastle Branck of Maplin last month and it was far from empty. It was like a junk shop ( over stocked and no space for customers to move) so i left.

    Opening a new branch by me, hardly the actions of a struggling company.
