in December 2011 my wife was driving her car and skidded on ice she skidded into a neigbours fence broke one upright and a couple of dozen lats, the fence was old and in a state of disrepair never seen a coat of paint for years, all she did was crack the number plate on the car, it was obviously her fault so not wanting to go through the insurance i said i would pay to have it replaced, i arranged for a local guy to come give us a quote he came out and quoted me £400 at this point the owner of the fence appeared and said he was wanting the whole fence replaced and not just the bit we damaged, no way was i going to agree to that so i told him to go through my insurance.
his insurers contacted my insurance in Jan 2012 to tell them about the claim, i took several photos and emailed them to my insurance along with the quote they had no more correspondence from his insurance after the initial letter, in Febuary of 2012 the fence was sorted and no more was said.
Two days ago we received a threatening solicitors letter demanding we pay £2200 for the damaged/replaced fence within 21 days or face being taken to court with added costs interest ect.
where do i stand in this as we are no longer insured with the insurance we had at the time ? i cant see my old car insurance helping us out as they agreed at the time that the damage was minimal and they wouldnt be paying to have the whole fence replaced !

Send it by recorded post to your insurer (that dealt with the claim). Do not respond to it directly. Let the insurer deal with it.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
Also send them the pictures you took, if you could take some pictures of the fence now eg showing they had the whole run replaced it might help.0

Your old insurer will definitely help you out.
If the third party take this to court they will defend and if they lose they will pay out as ordered by the court.
As advised above you should pass this and any further correspondence you get over this direct to the insurer and you should not engage or reply/argue etc with the other side.
If you get phone calls, stonewall and refer them to your insurer.0
