Amazon and San Direct breaching sales of Goods Act

Hi All,

Back in May 2012 I purchased a Bissell cleaner via Amazon from a company called San Direct. The item is no longer working and I assume inherently faulty. I contacted San Direct and advised them of this and they responded that there warranty is only valid for 90 days.

I've sent the normal letter quoting the Sale Of Goods Act etc and they just refer me too Bissell. I pointed out that in the first year my contract is with them, however they were having none of it. I took this up with Amazon and they said hey do not get involved with third party sellers.

I have requested the name and address of San Direct from them and Amazon. San Diret refer me too Bissell and Amazon have just given me a VAT number.

I have since contacted Bissell and they no longer sell the product nor do they do repairs. Any suggestions please?

    You contract is with them all the time, not just the first year.

    The fault may be inherent but after 6 months the burden of proof is on you. So they can ask for prove that the damage is in fact inherent rather than wear & tear or misuse before offering a remedy.

    Email them telling them you will obtain an independent report and if the item is faulty you will pursue them for a repair and recovery of the cost of the report. They may decide to do something to avoid the cost - otherwise you have to weigh up the pros and cons of pursuing it - especially where they could just offer a partial refund, leading me to the question.... how much did it cost?

    Did this ever get resolved? Found this link after Googling San Direct. Very little comes up in their name, in fact nothing at all. But appears that Mastronics is the name behind the VAT number. Wondering why these linked companies appear to be so anonymous. Have foolishly ordered a new printer from them via Amazon. Worrying that the VAT number address appears to be a tiny residential Victorian terrace house.:(
  • In the end they offered to replace the damaged item with an item of similar value. I ordered a toaster and was sent a kettle which cost more. Fingers crossed you might get what you ordered! :beer:
  • I am finding myself in a similar situation with an expensive electrical item bought from San Direct through Amazon Marketplace. San Direct has ignored all attempts to sort out the problem from Amazon, Trading Standards and the County Court. Amazon will supply a trading address if asked and the company has to provide one by law. I do not know how this will end but it is not looking good. I am really surprised Amazon endorses these cowboys by allowing them to sell on their site.

    I bought a Parasene Weed Wand from them through Amazon on 1st July last year and as this is a seasonal item didn't use it after September. When I came to use it last month it didn't work and I presumed that the gas was empty so I bought 2 more which cost the earth and when I tried them the wand still didn't work. So I had three cans of gas and nothing to use them with. When I phoned them up they told me I could return the item at my own expense for either refund or replacement, so I asked for a replacement. That was a month ago and I'm still waiting reply.
