Oooh, nice one crown. Don;t care it if does go to court, credit scores lower than Jordan's IQ anyways.

Think I'll give that a go, and see what like.
This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

I'm having similar problems with Barclaycard/Mercers. I'm 'happy' with the payment of 1% they have offered me but I'm having terrible trouble getting them to put the terms in writing. They bizarely want me to pay another 2 months interest (which will be over £400...) until they will freeze interest - but won't even put it in writing. All or my other creditors stopped interest back in January. I belive the only way they will accept less than 1% is to go on a 'proper' debt management programme through cccs or similar, wheras I wanted to do a 'self managed' dmp. I belive others don've have such problems if they are in a 'proper' dmp. They have also been very rude and aggressive, so I'm about to complain  . They are really getting me down to the point I'm now thinking of IVA.

Good luck & let me know how you get on with them...

Barclays passed this on to a compnay called CSL, I got some very nasty calls from them until I told them writing only. They told me they'd freeze interest if I made a payment, so I sent them £10 with my budget etc, they've taken a month to write back saying no, then another month to send out a 'we haven't heard from you, but if you pay a lump sum we can offer a substantial discount' letter. At least there's no interest racking up, so now all my debts are 0% thank goodness.

Have you dealt with Mercers too, or did they pass you straight to CSL? I was worried because Mercers said they were going to send a debt collector round yesterday (Sunday????) but every week they keep 'holding action' as I just keep saying I want it in writing. I don't trust them at all if it's not in writing. Saying I have to pay another 2 months interest 'to test my commmitment' is just a joke. When I told them I am committed to paying back waht I owe, but with nearly 30% interest it would be impossible one sarcastic **** said we don't do interest free loans! I wish I'd been quick enough to ask why they offer up to 15 months for new customers with their platinum card??? I really hate the idea of IVA but I'm warming to it with each nasty phone call.
Have you claimed your bank charges back (I've not started yet)? I guess they would knock them off your total outstanding debt to reduce it further. I know I need to do it, but I've not quite got round to it yet.

Yup, claimed my £2.5k bank charges back, but there's dragging their heels sending the cheque. I didn't get Mercers.

If you're stressing about it, call CCCS or National Debtline. CCCS sent me out a PDF with a budget sheet etc. I wrte to CSL after a particularly nasty call from tehm, enclsed my budget and made the offer of £10 a month. They've refused, but I think they tend to do that anyways.

I'd write to them again, telling them to take your number off their database and contact you by letter only. This will (usually) stop the calls) as it's illegal for them to call after you request to be taken off the database. Then put together your budget, and offe them what it shows you have left over to pay them. I'd also tell them you think they're trying to add more interest by dragging it out, and request that they freeze the interest upon recipt of first payment (and enclose it in the letter). If they dn;t I'd contact the debt charities and see what they say.

Worst come to worst they take tyou to court, and the court looks at your budget and decides what to pay, plus will most likely freeze the interest. Then Mercers have to explain why they haven't sorted it out before hand. Like to see most of 'em try!!

Don;t worry love, it'll all be right in the end. You really need to crack on and get them to freeze the interest though.

Hope you get the cheque soon.

Thanks for advice about phone calls. They don't seem to listen to anything I say, although I did manage to speak to one nice lady there on Friday who actually seemed human!

I've been dealing with Business Debtline who have been really good in pointing out bints in the banking code of practise etc.

It's not really stressing me out too much (it did at first) as I'm really lucky that my business is actually doing okay (it's just historic debts and cashflow I struggle with!) and my family have been really supportive. It also really helps to know there are other people in similar situations.

Thanks again and good luck with getting your offer accepted
