Trying to claim money back from the council

Hi I hope someone can offer some advice this is a bit of a long story but here goes, I bought my upstairs council flat under the right to buy scheme and was planning on remaining there however after purchasing it I developed rheumatoid arthritis and tried to hang on as much as I could but couldn't see the three years out.

The ideal property came on the market and we had to go for it but this meant sale going through in February and 3 years not up until Oct. I wrote to the council explaining circumstances and investigated on the internet and found a clause in the english housing act which states that if someone has to move for health or safety reasons then repayment should be evaluated individually.

I enclosed a copy of this and received a response stating that as I stayed in Scotland there was no such clause in our housing act so I had to pay them back over £6000. I contacted the citizens advice but they didn't really have any experience of this. Can anyone offer any wisdom as to where to go from here?
