Chargeback: Paypal Vs Barclaycard

Bought a new Nintendo DSi on eBay from a Chinese retailer with over 12,000 positive feeback ratings. Paid via Paypal, deducted from my Barclaycard. It worked on Christmas Day, but then not since. Initial correspondence with retailer was positive with reassurances that he'd refund or replace if it was faulty. Tried everything he suggested to solve the problem but it was clearly faulty.

Now I want to return it, the retailer has disappeared & won't respond to communication. Seems to have stopped trading under that name on ebay and now has lots of negative feedback about dodgy DSi's. :mad:

Too late to open an ebay or Paypal dispute as it's now over 45 days. Barclaycard say they can't do a chargeback as it was paid for via a 3rd party and they had no direct link with the retailer. Paypal say Barclaycard can do chargeback if I push them. Barclaycard aren't budging.

Anything I can do?

  • The problem is you did not pay the retailer for the item you paid PayPal to give the money to the retailer and as such PayPal have fulfilled their contract. This is why there are Section 75 issues with paying via an intermediary.

    That said, chargebacks are different to S75 and anyone can do a chargeback for any transaction and ultimately the creditcard company is the judge of the matter. Barclays, and therefore I would infer also Barclaycard, are always very reluctant to do chargebacks for whatever reason (even on fraudulent transactions) but as they are not a statutory right then you are at your banks mercy. I had to take my case to the FOS to get my money refunded.

    A chargeback can be actioned.....

    But you have to be aware that it may be rejected by paypal on the basis that all they were contracted to do was move the money. Not supply the goods.

    Go back and ask for the disputes department. Talk to the people who actually do the chargebacks.
    They will say the same.

    But they should action it for you. So long as you are aware that it may fail.

    Also you will have to return the faulty product, this will have to be by a trackable method. Can't keep both goods and any refund.
