    The gdc is for fitness to practice complaints the link you posted explains this. They can strike a dentist off but are not for individual complaints unless it is about concerns that the dentist is not fit to practice e.g. cross infection problems, sexual misconduct, drink/drug problems It may be that following the above complaints system may result in the dentist being referred to the gdc but most complaints should be resolved at practice or pct/lhb level.

    Thanks all for the replies. At no point was 'without prejudice' used in either letter.

    As for who is now dealing with the issue, it is the Public Services Ombudsman for Wales.

    So I shall await their decision for them to decide if there is a case to answer or not.
    And I have followed all the required steps throughout this complaint issue, so no hiccups there I'm glad to say.

    Well since the dentists letter or letters (you mention either letter)was some time ago as you must have exhausted the practice complaints system, lhb complaints, independent review before going to ombudsman and you must have said that you were not satisfied with the dentists reply I am somewhat confused why you are asking how you should act.

    Also as you are aware the ombudsman cannot order any compensation so the most you can hope for is refund of fees paid Im even further confused.

  • Just looking for clarification. Sorry if it confused you somewhat. Didn't want to pay the cheque into my account and be then told my complaint had been 'settled' and no further action would be taken.

    it depends on what further action you want taken. Financially the ombudsmen cannot order any compensation other than the repayment of fees paid. If you want further financial recompense then the ombudsmen cannot assess or order compensation.

    The problem here is you are supposed to have exhausted all avenues of complaint before the ombudsmen is involved. This has not happened if you are still corresponding with the dentist and offers are still being made.

    If it is not financial but other concerns that you want actioned then that is a different matter.
