Gym Membership - Standing Order not cancelled

Hi All, Well it's been 14 days since my letter and i received a response from the gym owner. They are not willing to pay back the installments, but are willing to give me free membership and PT sessions.
He keeps coming back to the point that they cant cancel Standing Orders (which i understand), however you would think he would have a moral obligation to return the money paid to him in error. If i was a pensioner and this was an error, i bet the money would be winging its way to my bank account sharpish...
As as per your great advise above, i will be pursuing the money through the courts.
Do you think i should respond to his letter and advise that i am going ahead with this action (as i did inform him i would if no refund) or should i just go ahead and not directly correspond with him again?
Advise would be greatly appreciated guys.

Just to add that whist it was your responsibility to cancel the SO, what was he doing accepting payments for non-members?0

Whos responsibility it was to cancel the S/O is a red herring. Its irrelevant.
