The last letter I sent my bank claiming £2414 within 14 days otherwise I will start court action has now past it's deadline. So tomorrow morning I will file online with MCOL. The main problem I have is I,m missing about 10 months worth of transaction from the middle of my statements, so can I start my claim now for the charges I can confirm and when i get the rest of the transactions make another claim? I'm only worried that as soon as i make the first claim I won't be able to claim anymore, however i don't want to wait for the other missing statements to arrive than have to give then up to another 2 lots of 14 days before i proceed to court action

So, you've rec'd some of the information from them, but not all?? I would be complaining direct to them or the info commissioner as they havent given you what you asked for in the first place.
With regards the claim, you give them 14 days to respond to the initial request, then if they dont reply, the next letter gives them a fruther 7 days or you will take court action.

Once this deadline comes and goes, then go straight to court. Not sure i'd want to be going through it twice though. Personally, and this is not to say its correct, i would be on at them to get the rest of the statements before i started proceedings or it could get very complicated.
