    lets not forget the bailiff has unlawfully clamped this car and is using it as a form blackmail to claim unlawful fees

    the bailiff has been informed the car does not belong to the debtor the threat of removal is just that a threat he knows he cant remove it so he has clamped it instead in the hope the debtor will pay up including his unlawful fees
    if the debtor offered the bailiff his £42.50 in legitimate fees do you think the bailiff would remove the clamp NO he wouldn't

    if its damaged that could be a different story

    also the op isn't responsible for the little scrotes that removed the clamp in the middle of the night and took it to sell for scrap

  • The bailiff has dishonestly appropriated property, belonging to another, with the intention of permanently depriving the other of it.

    That's theft.

    dannyjebb get on the phone to your MP tell him xxxx council have a rouge bailiff on there patch who has clamped a car that does not belong to the debtor has charged fees not set out in legislation and ask him what HE/SHE is going to do about it

    i agree you are right but getting the police to act against a bailiff ain't going to happen any time soon unfortunately

    Easiest thing you can do is pay the fees owed asap.

  • Have spoke to the ceo and at the council, and said if is not sorted today i will right to the papers, rang back the bailiffs and he is on his way to unclamp it. I asked him to post a bill through with all his charges so will update once i receive this
