ESA question

Hi
I have been on ESA for 13 weeks now, I broke my ankle,I have been to a interview with atos the day before my plaster was removed.
They said they would contact within two weeks and they hav'nt, I would like to return to work but my ankle swells up a lot when I am on it, I do a job which I am on my feet all the time, so was thinking of doing less hours for now so would probably earn around £50 a week,is it right I can still claim it till I can work the hours I used to.

  • Sounds like you have been on the assesment rate and the meeting was an assessment by atos to give info to the dwp assessor see if you should be on esa .. In either the wrag or the support group. Atos do the assessment but then information gets sent to the dwp decision maker.

    Are/where you an employee or self employed?

    If employed surely you would have been on SSP rather than ESA.

    Have you been receiving fit notes from your GP, they should outline what duties you can do, and maybe recomend a phased return to work.

    I am self employed and work as a cleaner I would like to return to work, but not fully as my ankle is still sore and swells up, the thing is would I still get ESA or will they stop it altogether

    ESA measures you fitness for any work, not the work you usually do.
    If you are otherwise well, even an ankle you can't walk on at all will not qualify you, as you may be assessed as reasonably able to use a wheelchair to mobilise.
