went to cornwall at weekend, broke down,called insurance about roadside assistance. man and truck arrived and told me gearbox had gone and they could give us a car and return mine on monday firm took visa debit card details and we drove home sunday. monday truck returned my car and took theirs, monday afternoon firm called and told me they had made mistake and should not have lent car/returned car and is demanding £400 to £500 for recovery. they have told me they will continue to try to take money from bank account even though i have told them i do not have that much in account, have told bank who told me they cannot stop it but will charge me for every attempt recovery firm makes. any suggestions/advice would be much appreciated

    Sorry i am a bit confused by all this and i think this may be why you have not had any replies.

    If i broke down i would call the RAC,AA or which breakdown company i was with,why phone your insurance unless you had an accident?

    Who sent the breakdown truck?if it was the insurance firm maybe they were trying to help you out,if so the cost would be down to you imo.The insurance company would only pay if they recovered your vehicle after an accident,then they would only lend you a car if it was part of your fully comp.policy.

    I'm not trying to be clever here, i just cant understand how all this has happened.

  • yes, sorry,we were driving without my docs but knew i had breakdown cover with morethan insurance, they put me in touch with breakdown firm who confirmed cover then recovered our car and lent me courtousy car following day they (recovery firm)said they had made mistake and that i should not have been recovered just had failed car delivered to nearest garage and that i am now liable to pay them for recovory, £400 to £500, as we had to give visa details incase car was not refueled or speed cameras recovery firm has said they will take money from account although we have not given permission for this amount

    It makes sense now i see what you mean.I dont really know where you stand legally but i would not be willing to pay for their mistake.

    Did you expect them to recover your car and give you another?what i mean is did you ever read the terms of your cover,which i assume was part of your insurance package.

    My advise would be to speak to the insurance again ,plead innocence and say that, had you known you would have to pay, you would never have gone along with it.It could be the recovery firm did all this thinking you would just pay up,this happened to me with a plumber who i thought was working on instruction of an insurance company,they then refused to pay saying much of the work was wear and tear and not part of my policy for emergency repairs,i thought the plumber was on the fiddle, stood my ground and finally the insurance paid.GOOD LUCK.
