Should ex pay me child maintenance?

Just wondering about your thoughts on this. I spilt with my ex over 2 years ago and we have a daughter together aged 6.
We spilt custody 50/50 (I have her for a week and he has her for a week)
When we originally spilt it was going to be 4 days with me and 3 with him but we decided this would work better in the long run. He has a good job - earns about 50k and I am currently a SAHM. He didn't pay me maintenance at the beginning because he was paying the finance on my car that we had bought 3 years previously at £150 per month. However this ended in March 2012. I have not asked for any maintenace since then as I am not sure I am entitled to anything because he has her exactly half the time. Should he still be giving me something or because he has her half the time does it work out as even?
Any thought/advice welcome...

    Why would he have to if custody is exactly half and half? Would you also pay him for the time he takes care of her?

    His salary is irrelevant. He has her for the same amount of time as you and manages to work, so you being a sahm is also irrelevant. What are you doing when your child is with him?

    Of course I may be wrong.
  • Does he pay for half the things she needs? Clothes, clubs, trips, etc.

    of course he does if he has the child half of the time. Needless to say that the grossly unjust system wont have it that way though.

    No, having her half the time means he (probably) pays for her meals when she is with him. It does not, necessarily, mean he takes her out and buys her stuff or pays his way.

    Disagree. CSA set maintenance for one child at 10% of net pay. It is reduced by the amount of time you have the child staying with you. You should be paying 5% to each other (half of 10%) so he should be paying you 5% of the difference between your salaries.

    That is all theory, in practice whoever gets the child benefit gets entitled to claim maintenance.

    Who pays her school trips? Uniform? School dinners? clothing? club subscriptions?

    I think that comes into it.

    Can I ask why you don't work? And how you finance yourself?

    No they don't.

    Since there is no current case via the CSA, any percentages are irrelevant.

    It would depend on whether the new system is up & running (using gross pay calculations) or whether they are still using CSA2 (net pay)

    Best way to ascertain if any CM is payable is:
    Who receives the Child Benefit?
    Who's address is registered at school/doctors?
    Who organises eye tests/dental appointments etc etc.

    If it's the OP....the she is deemed to be the Parent with Care & the system then allows her to open a claim for child support.

    Morally....it depends on who meets the day-to-day costs of the child & whether it would have a detrimental impact on the child's relationship with her father.

    This is totally incorrect.

    For a start, CM via the CSA is set as 15% for one child, 20% for 2 children and 25% for 3 or more children.

    If the OP claims the CB she can open a case via the CSA. Se can check online if she knows the NRP salary a guesstimate of what he would have to pay her. But of course, if they have a agreement where they share the cost of everything like school trips, clothing etc etc then maybe morally not really a case.

    I'd say the private agreement you have is fair. If he were to pay you child support then you should be buying almost everything for the child. As the costs are currently split i'd say it's fair.
