does living with parents affect benefits

HI

me and my husband are splitting up and he is going to go and live back with his parents until he gets himself a house sorted what I wanted to know is both his parents are on benefits (one is disability) would him going back there affect what they will get ?? (he is not working), he has just lost his job and is getting nothing as Job seekers said I earnt to much for him to get anything, would he be entitled to anything while living with them ?? he is looking for work and as soon as has job again he is going to rent a house somewhere.

    Yes, moving back in with his parents will affect their benefits.

    He will be able to claim JSA but will get no other help.

    It depends what benefits the parents get. DLA, for instance, is not means tested. The parents might have to pay more council tax now (more accurately, your ex would be due to pay it).

    You should look at the 'non-dependent deductions' table on the local council website which will clarify if there are any exemptions because they are disabled or if there is a modest deduction from their council tax/housing benefit discounts which he is expected to make up from his income based JSa.
  • You can still get DLA & ESA while living at parents, however housing & council tax benefit etc is usually a no.

    A few things to consider before a definite answer can be given-

    His age, are parents receiving care component of DLA.

    Has he not worked continuously over the past couple of years, if so he should be able to claim contribution based JSA in his own right and there may be no need for him to leave the family home......just a thought!

    If there are children involved you will need to inform HMRC of the change in circumstances and change from couple to single claim and inform Local Authority to receive 25% discount for Council Tax.

    Plenty of families go through problems when redundancy/no work is the issue, i hope you can both work through it and avoid this terrible situation.
    Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

    His parents are just fretting about there benefits being affected if he goes back to stay with them for a while - he is actively looking for a job but no luck so far as soon as he does find a job he is going to get his own place.

    Have you actually gone onto https://www.turn2us.org.uk and checked re Local Housing Allowance and Council tax benefit if you are together?

    You can use the same to check if he moves back to his parents.

    If he has been working and has sufficient NI contributions then he should be entitled to JSA for six months. If he's not then is there a problem with his contributions.
