P46 - present circumstances

Hi

My future employer has sent me the P46 form to fill in as part of my welcome pack before I start my new job on February 11th.

For the part pertaining to present circumstances, which box do I tick?

Statement A: This is my first job since last 6 April and I have not been receiving taxable Jobseeker's Allowance or taxable Incapacity Benefit or a state or occupational pension.

Statement B: This is now my only job, but since last 6 April I have had another job, or have received taxable Jobseeker's Allowance or Incapacity Benefit. I do not receive a state or occupational pension.

Statement C: I have another job or receive a state or occupational pension.

Do I answer it as I am right now? Because I'm currently working the notice period in my current job (which would be box C).

Or do I tick it as I will be when I start on Feb 11th? (which would be box B)

  • Why have they sent you a P46? They should wait for you to hand over the P45 that you will get when you leave your current employer. P46s are for people who have not got a P45.

    I have no idea! Is it quicker if they 'put something down now' than wait for me to receive my P45 and hand it in?

    edit: to be fair, I won't have a P45 on the day I start my new job..
  • It is normal practice to ask you for your P45 on the day you start if you are coming direct from another job: some people haven't got it yet so ask the new employer to wait until it comes.

    I would ask the HR people at the new place. I certainly wouldn't just send them the P46.

  • My Oh had to fill in a p46 when he got a new job and his tax was bob on from first pay day.He waited a while for his p45 to arrive.
    I take it you will be giving the p46 in on the day you start,in which case I would have said box B.

    You answer what it will be in your new job - so B. Sometimes there can be a delay with getting your P45 depending on pay runs, so filling in a P46 is often a good idea - it doesn't make any difference if you are on a standard tax code whether you hand in a P45 or P46.
  • You fill it in as your circumstances will be on the very first day of working for them.

    You should answer what will apply for when you start your job. In my view this is a good idea, you can hand in the P46 when you start, if your P45 reaches them before the first pay run they do not need to use it but if it does not then they can use the P46 and put you on emergency tax code untill the P45 arrives. Some employers can be a bit slow issuing P45s.
    Just a small note of warning regarding emergency tax, it may happen that there is an overlap of tax allowances with old and new employer which may result in in a bit of an underdeduction in tax which will be corrected if it occurs when the P45 is added to your pay records.
