Atos and their LIES

Hi all
I got my ESA medical report yesterday and surprise surprise I've been failed.
Not one word is what I said! I spoke to a dwp employee before my interview and he told me to record it which I did so I now have proof that they are lying!
This is a dangerous game to play with someone who has a mental illness with a history of self harm and suicide attempts.
In my first medical I scored 6 points for just suffering depression and on 50mg anti depressants. But scored 0 this time even though my meds have increased to 100mg, been diagnosed with curve of the spine where I have to take strong painkillers to try and manage the pain, OCD, BDD, paranoia and anxiety... How does that work?
I am now going to issue a complaint with atos, can I take them to court for compensation, defamation of character or anything?
This process is sending me into a downward spiral where I had to contact my doctor ASAP after reading the report.
Any help would be appreciated.

Can you contact your MP?
Get him or her to contact ATOS and the DWP.

I'm not giving up I won my last appeal and going to win this one.
Just furious as there is not one true word in the 'report'. Also I have a month to appeal, the letter was dated 14th dec I got it 16th jan. I recorded the whole thing so they can't back up their lies this time0 -
Good luck with your appeal. You can see now why Atos fought tooth and nail and still throw as many obstacles in the way of claimants not to get their WCA recorded.
You'll need even more luck with your complaint against this Atos so called "healthcare professional"!!
Certainly bring this joke of a WCA to the attention of your MP and yes hopefully they're not a tory or a lib-dem. Even if they are pursue it.0 -

Appeal appeal appeal. Get help from an outside source, whether that's DIAL, CAB or welfare rights officer at local social work department.4 Stones and 0 pounds or 25.4kg lighter :j0

speak to your GP, CPN (if you have), Mind Charity, Dial, everyone
if i were you id try to make some noise about it, without showing your face if you dont want, embarass them, especially with these sweeping changes coming in on the 28th, there should be a few journalists on twitter who should spread it for you (esa was tredning on twitter today)

Attempting to sue ATOS is very unlikely to work.
If your decision has not been made.
Contact the DWP, and inform them that there are significant errors in the medical report, and ask them to delay the decision till you send in details.
Now, work out what errors are important, versus what errors are simply irritating, and concentrate on the former.
'Claimant is fat' - is a perhaps unfortunate phrase that may annoy you, but is not relevant directly to the descriptors.
It is important to understand that you are not given ESA for having certain conditions (with some exceptions).
You are given ESA due to meeting one or more of the descriptors.
The HCP is not bound to take your answers completely at face value, but they should at least note why they disagree.
If the report is inaccurate enough, make a formal complaint to ATOS - see their website for the process.
If the report is inaccurate enough that you consider it beyond mere accident, or someone having a bad day - consider reporting the HCP to their professional standards body - for example, the nursing and midwifery council for nurses.0
