PPI Claim Help HSBC

Hi I need some advice re: a claim with HSBC for mis-sold PPI.
I had a loan about 5/6 years ago that I paid off and closed. I didn't keep any paperwork but do my personal banking with HSBC. I wrote to them using a template letter, requesting information under section 77 of the consumer credit act 1974. I gave my current account details and explained i had no account number specific to the loan but it would be on my financial history with them.
I have received a reply today that states "In normal circumstances, the request you have made under section 77 of the consumer credit act 1974 is not valid and HSBC has no obligation to provide the documentation you seek. This is because you have not provided us with a valid loan account number. Please note that Section 77 does not apply to a closed/repaid loan that is no longer in force. I can confirm that following my investigations I have found no record of any Payment Protection Insurance being attached to any loan with HSBC. Accordingly there are no relevant documents to disclose to you."

Firstly what do I do with regards to getting my hands on my documents if I don't have the account number and they won't give me my documents to check as the loan is repaid and closed. Secondly i am 99% sure that I DID have PPI on this loan. I remember firstly that I was told of a few 'conditions' to being accepted for the loan and also that whilst I had the loan I considered calling to see if I could cancel this insurance I didn't want, I never got round to it and i was made redundant and remember thinking oh thank god I never cancelled that but when I got the documentation out found in the small print that it was useless to me anyway! Therefore as I have not manufactured memories feel pretty damn sure there was PPI on this loan.

What do I do and where do I go from here?? Help??

    Send a SAR and £10, they may or they may not have your details still. If they don't, your complaint is over, if they do, full steam ahead!

  • Whats an SAR? They are saying they have records of my loan still they just don't want and are saying aren't obliged to give me any details??

    They're right, you can't ask for T&C's or agreements on closed accounts. You can howver, submit a SAR. Have a quick search to see what it is and what it does.

    You say about 5/6 years. Do you know exactly how many.

    They are allowed to destroy records over 6 years so if they have and have no records and you dont either then it is game over.
