Warning Tesco Direct - 28 Days Warranty Then Return To Manifacturer

Just a word of warning about purchasing electrical or other non-Tesco items from Tesco Direct.
I purchased a Samsung MP3 player in July last year from Tesco Direct for my son. It has developed a fault and needs either repairing or refunding under warranty.
Tesco Direct have just informed me that if a product develops a fault after 28 days they are not interested and you have to take it up with the manifacturer. When I asked them what would happen if it had been a television they had no answer.
They did of course supply the address and telephone number for Samsung UK!
Never, ever again will I buy from Tesco Direct.

In fairness to Tesco, most - if not all - retailers operate under this policy.

Whilst the supplier, not the manufacturer, is legally responsible for the merchantable quality of anything they supply (and your legal supply contract is with them, not the manufacturer) it is common for the guarantee to be supplied by the manufacturer and for them to undertake warranty repair/replacements.
It isn't really a problem - if push comes to shove, and the manufacturer fail to meet your legal rights, you can always pursue them against the retailer whatever they said in the first instance.0 -
Did you take it back to a Tesco store?
If you have the receipt I would do that, I took an I pod shuffle back after 5 months and they did a straight swap.

What you have said is correct to a degree, however -
The guarantee on an item is the responsibility of the supplier - no one else. If the manufacturer of the item agrees to carry out repairs on behalf of the seller, this is fine - BUT the seller is still responsible in law. Tesco are having you on by saying (in effect) that their guarantee is only 28 days.
Tesco are too quick to take people's money but are becoming more and more tardy when they should pay out. Why do you think their profits are so huge ?0 -
This crops up every other day on Ed Doolan's consumer program on BBC Radio WM. It gets him very angry when the 28 day exchange is mentioned. Someone from Birmingham trading standards was on his show the other week and they said the 28 day thingy is nonsence. They also said you have up to 6 years to replace faulty goods, but i think it depends on what you bought and how often it was intended to be used and the cost.

Good points, both. The 28 day thing is in addition to, not in replacement of, your legal rights which are against the supplier.
But pragmatically it is no difference to most people that their guarantee is backed by the manufacturer - indeed, it's better as once again it's additional rights not replacement of existing rights. If the supplier goes bust, you would have no cover in the absence of a manufacturer's warranty.0
