I visited my rented property today

We moved out on 17 november 2012 and the property has been empty since. The Letting agency called last week and told us that She has found someone who wanted moved in tomorrow. So we went to check the house together and she was too busy to come. At this point I was quite upset.

I went to the house and found the boiler was open. so no heating. one wall was damaged. God knows what happened. The thing is I wasn't informed of anything. I didn't know that British Gas came in and doing reparing. If I had lived there they wouldn't do that 'necessary work'. Would they?

Found the shed had a recovering as well without any notice given and ensuite bathroom had a patch work too. all without my knowledge. So I was very upset to find all this things. So I called the agency and the other girl hung up on me. without apology she said that I gave them a permission to do whatever they want to do to the house. How nonsense. I haven't had a proper checks with the agency yet. How can I let them come in and change things? I have been paying a full rent until now.

The owner of the agency called later (she made me come all the way and didn't turn up) I didn't answer because I was too upset to speak. She tried to contact me several times but I sent only a few messages. She needs to contact me urgently because she had a credit check on those new tenants now and it was ok.

Now she wants to take a new tenant in on thursday and said that she would go to the property and check them and photograph them and send me the details on thursday morning without my presence.

Is she allowed to do that? I want to get out of this nightmare but it's so unfair.

I have lost my time today and still so upset.

Can I refuse the inspection on thursday and choose my own time? Can she let another tenant in without my consent in writing? I don't have any written confirmation whatsoever. We don't have any signed documents about any agreement or disagreement. I have only 6 month contract and runs until 1 March. even no signed inventory.

What do I have to do?

    I think I worked out you are the tennant, if so, why are the works they are doing your problem (the heating, shed). If its empty and you are paying rent I don't see why you have to come into it?

    Also, if they are relieving you from your contract early and you don't live there is that not doing you a favour as your not paying out rent?

    I thought that the OP is the owner; moved out in Nov and only now has a tenant been found?

    I didn't really understand the rest of the post, though, sorry.

    OK. Calm down.

    First, I'm guessing you are a tenant. Yes? Or owner/landlord?

    Second, If tenant, then when does your tenancy officially end? Is it a fixed term? Date started, length of tenancy (eg 6 months) and end date?

    Or is it a Periodic (monthly) tenancy?

    I guess you have not given official notice (true?) so you are still the tenant, and still paying rent?

    Next - what exactly do you want? To end the tenancy? Earlier than the end date? Or earlier than your Notice?

    If so, surely you are pleased they have found a new tenant and are (presumably) preparing to end your tenancy and start a new one?

    Or do you want to move back in? Continue the tenancy?

    Once we understand
    a) the legalposition regarding your tenancy and
    b) what you want to achieve

    we will be able to advise you.

    sorry to confuse you.

    How is it ok to have an access to the property without the tenants' agreement? I am the tenant who moved out of the property on 17 November. Should I have been notified of all the works? I am still paying a full rent for the house. I am not happy to see one wall damaged now because LL will accuse me.
  • It sounds like you are paying rent for a property but not living in it, and it is probably vacant.

    If you are committed to paying the rent, could you do so by returning the property?

    Surely the sooner they find new tenants, the sooner this is all over for you. Don't you want that?

    Did you hand the keys back when you moved out? To end the tenancy? If so then the landlord or their agents can enter. I'm guessing you are still paying rent because the fixed term tenancy hasn't ended.

    On the other hand maybe you haven't ended the tenancy because you are keeping it till the end of the fixed term as you have to pay rent til then.

    Let us know which.

    Also check your tenancy agreement for clauses about being absent from the property for more than 28 days without informing the landlord as it could effect the insurance. They may be a requirement to either drain down the heating/ pipework or ensure the heating is on to keep the property at a minimum temperature and prevent burst pipes if you are going to be absent for a long time.

    I would also expect there to be a clause about notifying problems within a reasonable timescale.

    For this reason I once handed back keys early, even though the tenancy hadn't ended to avoid being responsible for a property over the winter.

    It sounds like the OP is concerned that the damage caused by boiler work while he has not been living in the flat it will be taken from his deposit. OP, is your deposit protected?
