I today was successful at my appeal i turned up to the meeting however the decision had already been decided and was given a letter by the secretary the letter says i have now been awarded the work related activity compenent surely this should say support group as i am already in the income based esa group?
My original medical was 21/1/12 however i filled in the original form back in august 2011 do i get the backdated pay from feb the decision where they gave after the medical or august ?
Why doesnt it say support group ?
it also saysthis is because insufficent pointswere scored to meet the threshold for work capability assessement ,but regulation 29 of the esa regulations 2008 applied
no schedule 3 decriptor applied
i am to be reassessed within 12 months
Thanks

You will get the extra money between the assessement amount and the WRAG backdated to the date it was stopped presuming you were receiving it before.
The support group is something different from whether you get income based or not.Lost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -

Also on the basis of the atos my DLA was taken from high rate for both care and mobility to the lower rate now i have won my appeal do i have the right to ask them to review this also i didnt appeal this at the time as one appeal was stressfull enough0 -

You have not been awarded the support group.
You 'won' in the sense that you have gotten an award of the WRAG.
You are at the moment getting the assessment rate only. This will increase, to include the WRAG component at some 25+ pounds a week, and you will be paid arrears.
You should have seprately challenged the DLA decision to change your award.
In principle, you can make a late appeal of this decision, you would probably need to get advice on this.
This victory does not directly affect the DLA claim, as technically, the DLA claim was not due to this decision, but due to the evidence gathered for it.0
