Disability Living Allowance And Severe Diability Premium

Hi can anyone please provide information regarding the following.

When I initially applied for DLA I was refused but won on appeal and was granted High Care and Low Mobility, payments were backdated to the original start point of the DLA

I am (and was) in receipt of ESA (Support Group).

I live alone and do not have a carer.

I'd been told by the DLA that the ESA people are made of any changes and that any further entitlement to Severe Disability Premium should be picked up at their end.

I waited a week or so and nothing happened so I contacted the ESA advised them that I met the criteria for Severe Disability Premium, they sent me a form filled it in, duly posted and waited. They advised form not received, reissued it and have awarded me my Severe Disability Premium, but only from the point of form submission.

My understanding from the original person I spoke to in the DLA is that any Severe Disability Premium should be awarded back to the point of qualification, is that correct?

I need to speak with the ESA about this so would like to be informed, any help would be massively appreciated.

Thanks

Tara

    This is correct.
You are entitled to SDP from the point at which you were entitled to it - and any backpayments.
    When you applied isn't relevant.

The tribunal decision is treated as if the original decision had gone the other way at the start.
If not resolved, phone ESA, and ask for a callback from a decisionmaker, to clear this up.
