Thanks all, I understand I've made a mistake! Is this just going to be an expensive mistake for myself? Am I completely stuffed?

Yes, one of the easiest ways to confirm a gift payment is to see if paypal fees were paid, if this had been received gross with no fees deducted then it would definitely have bebeen sent as a gift.

So your saying that because there was a deduction from paypal they are aware that a item was sold? Or something along those lines?

Edit: Maybe it is a long shot, but if this does go to a case, which I suspect that it will, is the buyer not partly responsible for the postage method as I did offer alternative methods?

    Almost certainly yes

No, not at all. As above- paypal do not care whether you can prove you sold an item or not- item 'Was' sold you got payment for it and under paypal rules that needs to be sent tracked to the buyer.

The paypal fees bit is just a way of working out how payment was made, a paypal payment received net of fees would be a payment made fro goods. A payment received gross is considered a gift payment and an INR claim cannot be made.

No, please read the thread and the fist few posts on the sticky postage thread. A buyer is not responsible at all for th epostage method, only the seller is. It is a selelr than needs protection and should use trackign and get insurance as necessary.

As a buyer myself if I was offered a tracked service or a standard one at a cheaper price why would I pay for the dearer one when I have full paypal protection anyway?

Fingers crossed that the item turns up, and it was a genuine delay with the post.

I did look at the feedback of the buyer and had bought lots of items and had 100% Feedback, I hope so too!

But buyers cannot get negative comments anymore. So their feedback will always be 100%.
