Universal Credit and Cont ESA?

I am hoping someone could help with some information on Universal credit.
My Husband is claiming CB ESA which will stop after 365 days in June 2013. I am working 24 hours and looking for a full time poistion. We have one child aged 10 years.
I am unable to open the documents on the DWP site to look at the guidelines, but after reading some of the threads on here wanted to know how it works.
My Husband will not be able to work (after 14 years on IB) and will not be entitled to any payment for ESA although he will still be on ESA with a nil payment as he still fulfills the points quota etc.
Does this mean we cannot fulfill the requirement for the hours and income required even if I can get a full time job? I would only be able to earn just over minimum wage for 1 person!
Any information would be gratefully received as I am still trying to work out the budget for when my Husband looses the ESA in June.

    Would he meet the mobility/care criteria for DLA?
  • I have recently filled in the claims forms for DLA - his problems are with mobility and also with care due to arthritis in his spine, neck, shoulders, knee and now his hands which are very swollen. He has lots of problems with his leg due to an accident at work and this has caused him to have prolapsed discs and 4 lots of surgery on this.

    Surprise, surprise he did not qualify!! I think I already knew that he wouldn't because of the booklet of notes for guidance they sent with the claim form, which basically said if you have feet don't bother claiming!

    He was advised to claim by his advisor at his work focussed interview as he is in the work related activity group. They saw how much pain he was in when he got to the interview, sweat was poring from his head and he could hardly sit down, this was just walking from the bus stop to the Job centre. They have said they do not want to see him again as they realise he is not fit for work. They said if they need to speak to him, they will just ring him instead.

    If you cannot walk without 'severe discomfort' - you are entitled to DLA high-rate mobility.
    He should appeal, if he can't even walk 30m without severe discomfort.
    (If his condition has existed for over 3 months, and is likely to persist for 6).
    If he cannot use a manual wheelchair without severe discomfort, or walk 50m - he is entitled to the support group of ESA - again - make a (late) appeal.

    No, because your conditionality would be 35 hours at minimum wage, which you would be fulfilling. He has no conditionality to work as he claims ESA.
  • Definitely appeal the WRAG grouping of his ESA - he should be getting support group most definitely.

    Those are the descriptors for ESA - Support group ones are 2nd ones and are marginally different to WRAG group ones. It needs to be as soon as you can and as Roger says even a late appeal is better than just letting it die off in June. If you can get him into Support group on Contributions rate, that will mean it does not end after 365 days.
