My niece travels to Spain every year with my parents, they have never had a single problem taking her. They have never been asked for a letter or to prove they have parental consent. There are no conditions made by the tour operators apart from everyone must have a valid passport.

Same situation really when a mother has a difference surname from her child, my sister has a different surname from her daughter and has never had anyone query anything when travelling.

I've taken my nephew (age 9 - with a different surname) away with us twice - both times it has been picked up on as we were leaving the country to return home on check in - Santander (Ryanair) and Orlando (BA) gave the same information - I should have had a notarised letter from the parents with me giving me permission to travel with the child - apparently it would have been essential for insurance purposes if my nephew had been taken seriously ill abroad and I had to make an important decision.

I don't know how you do this - I guess going to a solicitor - but I think if I was taking him outside the EU I would do this.
