Leaving work without notice?

Hi,
The company I work for, have no money to buy new stock, are in dept with and on stop from all their supplyers, They are asking me to sell stock they dont have to get some money in! I dont want to work like this anymore! I want to walk in tomorrow to tell them im leaving without notice?

I am also starting my own business up in design and dont want to waist anymore time with the company.

Can I claim benifits till I start receiving an income as self employed?

Will I have to pay them for leaving without notice?

Are they classed as fraudulent taking money for stock just to buy he items in?

I need answers ASAP please as i have to make a dission today :(

    You can absolutely tell them this - but don't expect them to be pleased, or to be in any hurry to arrange your final wages. If you have any company property (including uniform, stationary etc.) don't expect to be paid before this is returned; if you take more breaks that you're technically entitled to because they're friendly/lenient about it - expect these to be deducted from your final wages, even if they weren't normally. Expect it to be an absolute nightmare.

    If you leave a job of your own accord, notice or not, you cannot get JSA for up to 6 months. That's 6 months sanction from when you apply, so don't think that waiting 6 months before applying would help. Same applies (I believe) to income support?

    Possibly - if they decide to take you to court and can demonstrate the financial detriment you caused them.

    I don't know to be honest. I would imagine not as if you think you can afford to just walk out of work, then you clearly don't need the JSA money - that's their perspective.

  • But im leaving on the fact that I dont think they will have the money to pay me at the end of the month, I just did a sale for over £50 at the end of lastyear, and know they have spent the money on paying depts and now dont have the money to forfill the order completly also that the product they have sold has failed testing and not yet been developed properly! this among many other factors makes me not want to step back into that place again with directors lieing and hiding the truth. They are demanding that I make amounts of money or they will go bust by selling stock not in stock, this is no way to run a company :(

    Taking the moral reasons out of the situation, it is not really your worry they they haven't got the stock to sell. It's up to you to sell the product and get orders by the sound of it. So I would just carry on selling whilst looking for a new job.
  • I want to start my own company but do need the saftey net of benefits for the next 2 months till I'm up and running.... I think what im looking for is a good enouth reason to walk out yet still claim some sort of benifits for two months, I have been with the company for 1 year now (just over minimun wage) all the stress dosent seem worth it... I am tired of customers complaining for the poor service we have to supply and the lies i have to tell :(

    check the conditions of your contract, you may only need to give a weeks notice anyway, or a month generally, so do that so at least you have a definate date to leave, you leave on reasonable terms with no court action, recriminations etc. In the meantime do you best to keep chin up, hope youll get paid before leaving, do what you can re your business and/or finding work, look into the benefits etc, basically prepare yourself as much as possible. Partner was given 1/2 hr notice to leave premises when he got made redundant, not even enough time to make sure hed got all his stuff from there. So make sure you take your personal bits home with you daily. good luck.

    As far a I am aware the DWP will not accept any reason, however compelling, for you walking out of a job of your own volition and still qualify for work-based benefits.


    I would advise you to not consider doing this, however strongly you feel you aught to or should. Not until you've had a very close read of the DWP website and acquainted yourself with all of the conditions of qualifying.

    That the company is asking you to take orders for stock they are not holding and appear to not be able to pay for is not your concern. You and your family's welfare is.

    My advice would be for you to keep your head down and get applying for other jobs while you're still getting paid.

    If OP is leaving to be self employed, could they qualify for IS. They won't be eligible for JSA, but becoming self employed isn't leaving employment, it's changing...

  • So what you are saying is that if I left now I wouldnt be claiming JSA because im leaving to become self employed, so should be elgible to claim income support?

    I am currently setting up my website for 3d rendering in many sectors with a good list of clients, but currently I need around a month to two months to market myself properly and compile more examples on my website. In the mean time I need to know that I will get some sort of money to keep me going (income support?) I have 4 children and am renting a house. I feel waisting my time at my current job is holding me back from what I could be earning in two months (almost 1 months wages in just a week)

    Time is my biggest need right now with a side order of finance from gov :)
