Has he sent that letter? If not would pull it as think will guarantee he will never work with them.
I would go from perspective of really keen to work for you would you allow me to apply once the conviction is spent.
Thanks will put this in as we have not sent it yet, however at the same time we do want to request a copy of the information they hold, how could I reword it without sounding too confrontational.

Why do you need the information they hold? I can't see what you would gain. Fair enough if there was a chance the information was incorrect and you wanted to appeal but you know what it will say.
The fact that others work there that have a criminal conviction is irrelevant. They may have disclosed them and/or be different type of offences.
To me the reason for the withdrawal is also to do with the non-disclosure as well as the nature of the actual offence. I appreciate it was an honest and genuine mistake but to the company it may look like he only disclosed as thought he would get found out. Also given the jobs market I am sure they can easily fill the vacancy.
If it were me I would do everything informally (if you can phone instead) and grovel!

Also agree that the letter looks confrontational: maybe a phone call to check whether if he'd disclosed at the time this would have been the reaction, maybe asking for a reconsideration, but probably best to put energies into looking elsewhere and getting it right next time.Signature removed for peace of mind0 -

Your OH was required to disclose his conviction and he failed to do so - unfortunately, ignorance is not an excuse.
If your OH was at all unclear about disclosure requirements then he should have taken advice before completing his declaration.
This isn't just about him having a conviction. From the company's perspective it is about his failure to declare that conviction... why would they want to employ someone that, at worst, lied or, at best, is an admin nightmare?

Thanks for all your replies..I think we will go ahead and send the letter but before doing so will reword it to make it sound a little less confrontational because you never know they might see past it and let him on....or at least give a clear explanation as to why they offered him 2 start dates and then declined??.... Request for DPA information is so that he can see a copy of his CRB to see exactly what it says,,,Once again thanks for your advice,,I will update once we hear back from them. x x x x0

If the employer carries out CRB checks it must have a policy on employing ex offenders.

The certificate should have been sent to your OH so somewhere (maybe in the post) there has been a messup. He should be able to get a copy from the CRB.But a banker, engaged at enormous expense,Had the whole of their cash in his care.

Thanks guys we decided not to send the letter as it was a bit confrontational having re-read it so he decided to phone them and literally grovel as the above poster mentioned afte was wishing him the best of luck and success in future job hunting he gave us his e-mail address and asked to email him what had been said over the phone so OH has sent the following e-mail.
Hi Mr XYZ,
Following on from my appication not being successful due to my CRB check its come to light there is a change of law and my conviction will be spent after 2 years from the original date which was 2008.
I have worked very hard to pass my theory test and progress my career with XYZ and have waited ten months. I can fully appreciate that I did not declare my conviction at the start of my application, however it was a genuine error and soon as I realised my offence had not been spent I called up and advised yourselves immediately.
I can promise that I am now a reformed character and would not in any situation make this mistake again. I would really appreciate if I could have a chance to prove myself. I have passed a majority of the training for XYZ and it has been a very long process. I am really keen to work for XYZ and I really hope you can help me in some way.
Could you please reconsider my application and ask someone to look into this for me again?
Is there anyway I could fast track my application once my conviction is shown as spent?
I am also willing to pay for my training so I can progress my career with XYZ or be taken on, on a temporary or voluntary basis so I can prove myself.
May I also kindly request information which is held about me relating to my job application with XYZ.

Current legislation
Under the current legislation, people with a criminal record have the right not to disclose their offence after the following periods:
- Offences resulting in prison sentences of six months or less do not have to be disclosed after seven years.
Under the amended legislation, rehabilitation periods would change as follows:
- Offences resulting in prison sentences of six months or less would not have to be disclosed after two years.

Im hoping this sounds alot less confrontational and hopefully they reply quickly.
With regards to a copy of his CRB or DBS as its now called he has had nothing in the post will get on the phone to them first thing tomorrow.

Hi Yvonne,
no update as of yet, he called the DBS advising he has not recieved a copy of the crb phoned disclosure scotland as well just in case they had done a basic check and both said no checks have been made:eek::eek:. So he called up the company and spoke to someone the person he e-mailed on Wednesday was out of office on Thursday. Still not heard anything:mad::mad:.
