    I appreciate what you are saying and in all fairness do agree, but he was really looking forward to this and they kept him waiting for 4 months before replying so he really had his hopes up especially after asking him to start in November then cancelling because the instructor was off ill,,,He really wants to try... they may change their mind may not. At the moment he just feels like a failure and that everything is going wrong for him.:(

    Just to say.. I think the company at least could have rang and spoke to him though and offered a proper explaination and give him time to ask any questions/get some feedback on the application. This was over an 8 month period, they changed the start date and then just left a message out of the blue. Over that period of time, you think you've got the job, have a start date and are sorted.. Only to be back at square one again. Must be stressful..

    On a more positive note - changes to the law due to come in this spring, will reduce the time for a custodial sentence of less then 6 months to be spent to two years (down from 7). The change will be retrospective, so sometime this year, his offence will be spent.
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

    Exactly he really had his hopes up...Twice they offered him a start date first time it was postponed because he told them of the CRB and second time due to inspector being off ill. It was also a 10 month period the initial application process began in March.:mad:

    This is an employer that regularly carries out CAB checks, they will almost certainly know this.

    Your letter is asking for DPA information, and details of the appeals process. Which is quite confrontational and unlikely to make them more likely to reconsider their position. Quite apart from the fact that there is no requirement for an employer to allow an appeal against a decision not to appoint.

    Frankly, I think he is on a hiding to nothing. He will probably be better off waiting until they advertise again, once the law on spent convictions has changed, so he will pass the CRB check.

As they already have some ex-convicts working for them but are unaware as they havent done the CRB yet.     Has he sent that letter? If not would pull it as think will guarantee he will never work with them.

    I would go from perspective of really keen to work for you would you allow me to apply once the conviction is spent.
