Probate queries ?

My father passed away earlier this week and it is my intention to process the Probate myself, being joint executor with my wife and myself as the main benificiary apart from cash sums to the grandchildren.
To this end I have a couple of queries (hopefully not too many more).

I have an EPOA over my fathers affairs, including a debit card & cheque book for his current account.
Is it ok to use this account as the 'exectutors account' which I've just found out about on this forum?
I've written a cheque on this account towards the funeral costs, which I was going to take to the funeral directors tomorrow, but now I'm concerned about being in the wrong legally.

Do you have to get a professional house valuation or can you use local knowledge to put a cost to the house? Could also use the past prices of nearby houses.

    POA ends with the death of the person.

    You need to tell the bank and the account will be frozen. However they will release money for the funeral

    Valid question.:) Scots law does vary from England and Wales in some areas.

    Howw big is the estate, if it is close to IHT a writen pro valuation may be usefull.

    Start with local knowledge and 2-3 estate agents to get an estimate.
  • (Assuming basics are same in England and Scotland).

    EPOA ends at death.

    Inform bank of death. They will freeze accouns, but will set up Executors Account for you to gather all the assets into. You won't be able to withdraw money/write cheques from this Executirs Account until probate has been granted (i.e. you have been confirmed as the Executor).
    However, if you send the funeral invoice to the bank, they will pay the Funeral Directors dircetly from the account.

    Scottish law is very very different, particularly regarding inheritance.

    OP - you need specific advice - I suggest you edit the title in your post to indicate that the death happened in Scotland.
