    Actually it doesn't, the NICs are paid because a claimant is entitled to an appropriate benefit and are not entitled to payment. This is the result of an earlier Welfare Reform Act, I think 1998, but don't quote me on that.

    The WCA is purely related to the ESA Regulations 2008, which make no reference to the payment of NICs.

    So the NICs are paid because a claimant remains eligible for ESA, which is why I've said that not receiving the NICs doesn't mean you lose your ESA.

    But to repeat my earlier post, why make things more complicated for yourself than you need to, just keep receiving the NICs
  • Thank you very much for the help, much appreciatd. i will be getting my hubby to read this as some of it was a bit difficult for me, such hard to read aand write (and comprehend) when i used to help teach it!

    come monday i will be on the phone to ask for a new form. i'm angry that the cab gave me wrong advise but i know they are very stretched round here and it's only part time open.

    my husband is now my full time carer, 3 years ago he had to give up his job which he was good at and loved, a big source of sadness and guilt so i a am hoping i can continue to get eas after the year, otherwise.. big gulp! doesn;'t bear thinking about.

    Blue Murder, you might be entitled to income related ESA if you + your partner's joint income is low enough.
