Consumer rights if over a year old

I have a memory card (Lexar 32GB Micro SDHC High Speed Memory Card) which i bought from an Amazon third party seller in Sept 2011 for use in my mobile phone. I have had frequent problems with it and am now convinced having used it in a new phone that there is indeed a problem with the card itself which causes data corruption.

Would I still be in a position based on consumer rights to return the card to the seller and expect a refund?

    Try this

    In short: Your not entitled to an automatic refund, and you will probably have to evidence a manufacturing fault existed at time of sale.

  • You pretty much have no chance here. Considering the cost of a new one is relatively small it wouldn't be worth pursuing it as you would have prove that the fault existed when the product was sold.

    You say it's a high speed card but does it give you the transfer speed or a class number?

    Test it with this program. If it reports errors or that it is a smaller than advertised capacity, then you will have hard evidence to get a refund through Amazon. It sounds like it is using fake flash memory, which is not too surprising if you bought it off the marketplace. This would be less of a manufacturing fault and more evidence of the production and sale of fake products.
