Hi
I am all new to this so please bare with me, i shall give a little back ground.
On the 26/10/12 we were called in to my former Directors office and told that as of the 31/10/2012 the company was going into insolvency and we were all being made redundant, on this day we received our letters which also stated that due to the severe financial demise the company would not be able to pay our redundancy, and we were to claim this from the RPS. RP1 duly completed and returned to them, we received a reply stating that we were not entitled to the redundancy money because it initially lies with my former employer and they could only pay out if the company has accepted or been proved by an employment Tribunal to be responsible for it but cannot pay. Also not entitled to Notice pay because they believe he has not gone insolvent. Companies House says they are Active preparing to strike off, now i know the company has closed and the Director returned to live abroad.
Anyway sent in a claim to the ET and have received a date of the 22nd feb for the Hearing.
Now i do not think that he will put in a response as he is not in the country nor do i think he will turn up to the hearing, we are representing ourselves (there are 3 of us), the only paperwork i have is the redundancy letter is there anything else we can do to prepare, as i say we have tried to contact him but to no avail.
What can we expect to happen at the hearing
Any help would be gratefully received, sorry for the long post.

Lynda - I can't help on your issue, but didn't want to read and run. Sorry to hear your news. I hope you find something else soon, and that the redundancy money comes through.0
