Esa refused after interview, higher dla granted

Was refused my ESA after the Interview,As they say i'm fit for work,But got Higher DLA,Cant understand that all,Has anyone else had that problem?

It's nearly the same for me, I get DLA highest rate of both componants because I have bad mobility issues and care issues for which I need a carer, I was granted ESA but put in the WRAG without a WCA.
I was given interverviews over the phone and via email after going to the job center twice and not managing very well, my job advisor had now put me in the work programme and a lady phoned me at 7.30 last night to register me, I told her I wasn't well but she said if I didn't register at that time I would lose my benefit so I had to answer questions for 20 mins last night.
She then said I would hear very soon from a consultant from the work programme who I will have to see every week for 2 years or untill they got me into a job, I tried to tell her there was no way I could work due to my problems but she just said if I didn't go I will lose my benefit.
I have appealed the WRAG decision but it won't be heard untill at least May so am stuck really. I'm thinking that I really want to tell them I no longer want to claim as its just causing me more harm doing what they make me do but by doing that we would not survive on what money we would get.0 -

Please note I can only relate what has happened to me - I was placed in the work programme as I receive ESA{WRAG} but up to now they have not mentioned anything about them wanting to see me every week.
it works out on average at being seen every six weeks and sometimes there is a eight week gap - it may be because they are very busy - I am being seen at a local office run by Avanta in Enfield although its mainly people on JSA rather than ESA - so far its very short interviews and I am in and out of their office within ten minuets - they have not suggested any courses or anything.
It may be different in another area or with a different provider but so far it has not been as bad as I was expecting.0 -

Thankyou Brian that's made me feel a bit better, I know it might be different in my area but it's given me hope lol, to be fair the letter I received from the advisor at the job center said the meetings with her would last for an hour but I was only there for around 10 mins the two times I went so maybe it will be the same for the WP
But then again I am in Weymouth so I doubt they will be as busy as a big city like london0 -

Conditions of entitlement for the two benefits vary.
You can be entitled to one, not the other.
However.
Have you requested a copy of the medical report made?
This can be the first step in appealing a decision.0 -

From what i have learnt while i was on ESA WRAG you will be seen fortnightly or monthly whichever they feel is appropriate. Where i go it is only weekly for people on JSA to do job searches etcCashBack earned to date - £1244-580

It varies.
Some claimants may be forced to do continual work placements (this would be rare), many more will be seen at interviews spaced several weeks apart, and some (including me at the moment) will have been handed off to a work program provider, who makes one phonecall, and decides that the chances of getting me into work are zero, and therefore there is no point in them spending money on me.0 -

although its a Avanta office when they print out a appointment letter they use a Maximus letter heading so they must be acting as agents for Avanta.
its all very low key but I think its because I am on ESA.
now that I am being seen by Avanta I was told by my ESA Advisor that I don't have to see her again.
I was under the impression { from the ESA Advisor } that I also would have to see Avanta every week but that certainly has not been the case.
Each time I see Avanta we fix up the next appointment date so its not me telling them it cant be every week - the only change I requested was that Avanta wanted to see me on a Thursday but that is when I see my Consultant so they shifted it to a Wednesday.

Did you appeal the WRAG decision before you were referred to the Work Programme? If you did then your adviser could have exempt you from going to the Work Programme but manadated you to the JCP offer. With the JCP offer you agree with your adviser the level and frequancy of contact. If you have appealed since then speak to your adviser and inform him/her that your appealing as you believe you should be in Support Group and ask if your Work Programme participation can be exempt till you have a decision.0
