Debt Relief Order

Hi to you all

I am looking for some answers, so it can help me decide whether to put mypartner through a DRO. Her debt is lower than £1500 and we have no assetsaccept TV’s, laptop etc and we have no extra money once all priority bills havegone out.

1. Both my partner and I are casual workers and our wages are never the samemonth to month, how will this affect the DRO? I know I will earn at least £900and my partner £400 a month, but obviously we could earn more if there is moreshifts on the rota.

2. Does the intermediary/OR go through a budget plan with you?

3. We have a car on HP which is in my name; will this affect her applyingfor a DRO?

4. We had an overpayment with our tax credits it’s in both of our names butcould she put this with her debts?

5. From someone that has experience in a DRO what is life like within the 12months of the DRO?

6. I have debt too, and was thinking of a DRO as well, but have oneproblem the car that is on HP. In my budget plan with National Debtline theysaid to put the car in our priority debts, If I were to go for a DRO would this beincluded in the DRO?

I hope I don’t sound to dumb, it’s just all the stress.

Many thanks to everybody that replies.

    1. Both my partner and I are casual workers and our wages are never the samemonth to month, how will this affect the DRO? I know I will earn at least £900and my partner £400 a month, but obviously we could earn more if there is moreshifts on the rota. The DRO will be based upon her income only, and the outgoings she spends her money on.

    2. Does the intermediary/OR go through a budget plan with you?Yes

    3. We have a car on HP which is in my name; will this affect her applyingfor a DRO? No.

    4. We had an overpayment with our tax credits it’s in both of our names butcould she put this with her debts? Yes, but you would remain responsible for the whole amount.

    5. From someone that has experience in a DRO what is life like within the 12months of the DRO? I am told, very uneventful!

    6. I have debt too, and was thinking of a DRO as well, but have oneproblem the car that is on HP. In my budget plan with National Debtline theysaid to put the car in our priority debts, If I were to go for a DRO would this beincluded in the DRO? That depends. If the payments are up to date then you could elect to keep it out of the DRO, and continue to pay. If the value of the car (it is not YOUR car) exceeds £1000 then it would not be an allowable expense - however, someone else could pay.....- of course if you wish you could put the HP in to the DRO, but you would lose the car.

I hope I don’t sound to dumb, it’s just all the stress. Dumb, is not to ask.

Many thanks to everybody that replies.

Thank you for the reply, very helpful.

    Question 2.
Will the budget plan be similar to the one I did with National Debtline?

    Question 5.
I'm not to worried about the 12 months being uneventful as the past year has been like that, I think the only difference will be knowing that some debt will be gone.

    Question 6.
We owe around £8500 on the car obviously we would loose the car, but if I was to ask some to take over the car, how would we be able to get another one as we rely baddly on it?

Once again thank you for taking the time to reply.
  • Did mine in March 2012. 2 more months to go...

Nothing's actually happened. It hasn't caused me any issues. Nothing really other than now not having to try and find money that doesn't exist. It's been nice only paying for things I'm using rather than paying for my past!
