living social deal voucher - restaurant closed

I have a voucher that I bought for £50 it is still in date I went to book the meal and the restaurant has closed down.
I contacted Living social deals but have only had a generic reply so far.
Should they refund the money?
Has anyone else had any problems with them?

Under the act, a credit card issuer and the retailer have joint responsibility for your purchase if there is a breach of contract or misrepresentation – for example, if the item is faulty or the company goes bust before you receive your goods. Plus, Section 75 can even give you protection for any costs that you incur as the result of the breach of contract by the retailer.
Certain conditions have to be met for Section 75 to apply, for example, the purchase needs to be over £100 and under £30,000.

I tred to contact them through their site 5 days later no proper reply just their generic confirmation of receiving my message.

Living social e mailed me to say they were sorry that investigating and once the vendor had replied to them they will contact me.....well I will be waiting forever then as the vendor has up and left and will not be returning their calls!Thanks for contacting us!

It seems their customer service team were reducedthe company announced layoffs of 400 employees, or 10% of its global workforce. The majority of the layoffs were in the sales, editorial and customer service departments.

You need to plough through the T&C's to establish whether
- the restaurant is the agent of the voucher co in fulfilling the voucher co's obligations to you
- the voucher co is the agent of the restaurant in selling a meal to you
You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0 -

I was getting fed up of waiting for an email reply so I gave the contact number above a call and after a short wait on hold was told that they would be refunding the card and it would take 3-5 working days. i asked for a transaction number (i dont know if you get one with refunds but thought it was worth a try!) they said they didn't have one but that it would be refunded to the card ending ****
so fingers crossed I will be reporting back in a few days that this has happened which will be fair enough
