    How can it be a free pot of cream when you have to pay postage ? Im sure I've read something similar on here re send us some dollar and we send you a pot of cream if we get round to it once we have smoked our spliffs.

    Doesn't sound like fraud, more like a scam.

    Just tell the card issuer/bank the payments weren't authorised and charge them back, give the firm 7 days to refund or do the chargeback.
    Unless specifically stated all posts by me are my own considered opinion.

    Isn't a scam basically fraud?! :s

    The members who said no terms and conditions was present for example would be classed as 'Fraud by failing to disclose information'

    Just because it's fraud doesn't automatically make it bank fraud. Just ask the victims of Farepack, Charles Ponzi, Crown Currency Exchange...........

    No chargback option as the OP agreed to the debits when they ticked the T/C and gave their card details. Unauthorised (there is no such chargeback). Would see the company provide OP's details and they would then be redebited.

    Saving grace is that now. Any further debits can be claimed back as a cancelled CPA.

    OP do not be embarrassed. There are thousands of people in the same situation.

    What surprises me is the police gave you a CRN for this as it is not fraud as delt with by banks. ( I deal with this on a daily basis)

    I worked for a company that had an 'opt out' on recurring transactions and got chargebacks all the time from people who got rebilled and then said they'd cancelled the transactions (they hadn't even attempted to contact the company 99% of the time) despite the company having the t&cs ticked etc etc.
    Half the time they even had emails from the punters AFTER the chargeback admitting they hadn't cancelled before transaction dates -the card issuers sided with their customer 90% of the time.
    The Visa regulations actually expect the company to prove the cardholder hasn't cancelled not the other way round!

    They also had unauthorised claims they got charged back for: can't see the difference here?

    I thought the OP said there were no T&C's available to them via the site: if the customer can't view them then surely they can't actually be bound by them?

    2 things

    1) We have no idea what the OP told the police
    2) A police (not crime) reference number is given to anyone who phones up to report anything, and is not based on any investigation. Getting a reference number means absolutely nothing. I rang up to report a car that had hit a wall on a slope. Could have been anything, but I was given a reference number over the phone then and there.

    You have the right to reject on the basis they have not cancelled. And we recieve these back all the time and redebit customers. Unless they can prove the cancelation date. Email etc.

    PSD (payment services directive) now means a person does not have to cancel with the company. They can simply instruct their banks to stop payments.
    As such any after that date can be returned by the bank...
    Blame the EU for that one. Seems that the EU feels NO T/C are worth a light :mad:

    On these sites you have to agree to the T/C by ticking a box to say you agree. Fail to read.... Well say no more.

    But people argue they have never seem them... Same as they argue they have never signed upto amazon prime... Despite it being VERY CLEAR when you tick the box and also shows on your home page as you are a prime customer , as well as sending a email :rotfl:
