Csa dispute driving me mad

I have never posted a thread before so apologies but I am at my witts end with the Csa and need a bit of hep.
My partners ex took him to the csa and we have been paying this since 2008. We have questioned several times the payments as we believed we were paying to much. We were paying £380 per month and they were saying we had arrears of nearly £5000 my partner only gets £177 a week and we have another daughter together. Finally after nearly 3 years they have now agreed we have been paying the wrong amounts and have reduced our payments but when we mentioned the arrears as these are worked of the wrong amounts we were told they cannot change these we have tried ringing sending letters and getting no where. They keep saying we should of told them we did but they have no interest in trying to trace our calls that prove this. I really would not mind paying these as I agree my partner should pay for his child but his child but his ex is claiming as a single mum and she's not just bought a brand new house and new car and works part time me and my partner work full time and cannot afford anythink:(. Am I right in thinking they should take off the arrears we have over paid on any help would be much appreciated

  • This is my first post as well. I am in a similar situation. I have been paying £200 a month for 11 years. My son used to stay with me 3 weekends out of 4 and stay with me on a Wednesday. So virtually equal custody. The csa said to pay £200 a month which I did by direct debit. I have now found out because my son was with me for equal time each week I should have been paying a reduced amount, possibly none at all.
    I have now had a argument with my former partner and she has stopped me from seeing my son and brought in the csa again who have informed me that I have to pay £90 a week now. I am earning less money than I was when they made the incorrect first judgement and I have a new child, how can this be right??
    Is there anyone who knows if I can claim back the incorrect first amount. I don't really care about the money I just want to see my son but I do not want her getting money that she should not be receiving I would rather put the money away for when he turns 16. I cannot understand how this organisation has been allowed to run over people and ruin people's lives. Yes there are people out there who do not want to take responsibility for their children but they are not being crushed by this organisation who are meant to be helping people.
    With the amount of people who have been affected, they should have some kind of commons review!! I know they are fading the csa out but who says the next organisation will be any better. Rant over.
    If anyone has any suggestions I really would appreciate it. Thank you

    Apply for the case notes. It costs £10 and there is a sticky of how to get them on the CSA board. From there I suggest contacting your MP if you have no joy having the arrears reassessed.

    Dont worry yourself what the mother is up to. She cant be on benefits and buying a new house as you suggest as she wont get a mortgage! The fact there are arrears on the case shows the NRP has not paid at some point?

    Ensure your current assessment is correct, that they are using the correct salary and giving a reduction for your other child. If all is correct then just suck it up. Are there arrears on the account?

    Regarding contact, this is a separate issue and if your ex withholds contact then you will need to apply for a contact order with your local court. This costs £200. You will not need a solicitor.

    To be fair, although the CSA does mess up at times, it works well for many people. Without the CSA, I would still be chasing my ex for maintenance. Instead, after over four years avoiding any payments, he now has regular payments taken from his wages. All arrears to me are paid, and I would think that arrears to the Secretary of State have probably been paid by now as well.

    Without the CSA. my ex would still be avoiding paying anything for the children that we brought into the world together. As it is, he avoids any childcare, appointments, etc. It's only fair that he pays towards their needs.
