Problem with car bought from garage

I bought a 2007 Fiesta from a local garage. The garage is also an MOT test station and put a full years test on which it obviously passed and on right hand side said slight leak from centre section of exhaust.
Within a week that slight leak had turned into a bit more than a slight leak and it also had an idle problem so I returned to the garage.
They initially said the idling problem was normal for cars with K&N filters on - which was on the car when I bought it not something I fitted. Absolute rubbish though as I googled it and found it was a common fault on that engine and needed the throttle bodies cleaning, which they did and fixed that problem - although has to a small degree returned.
They basically tried to fob me off on the exhaust saying every stainless steel system leaked - which again was absolute rubbish as I've had stainless systems on quite a few previous cars and wouldn't do anything about it.
I then took it to another garage for second opinion and when they put it up on ramp there was two problems with the exhaust. There was a crack around the top of the mid section box and the back rubber mount was knackered and basically the exhaust was hanging on at that point with a cable tie.
I went back to the garage but the salesman wasn't in and the mechanic put it in their ramp, replaced the rubber and put a bit of exhaust paste round the crack claiming the exhaust passed an MOT and it basically has to be hanging off to fail.
The leak went away for about a day but now its blowing just as bad as before and the garage are refusing to do anything about it. They claim its not their problem they don't cover exhausts, but i'm sure this would be covered under the sale of goods acts as after all this is a problem that was there at point of sale.

What sort of boy racer car have you purchased? K&N and stainless exhaust.
I bet it has been well thrashed hence the poor running.Google gives you answers use it.........0 -

No it doesn't void my insurance as they were both listed. Its just a Fiesta and apart from the exhaust its in good condition.0

Find a local exhaust company that can give you a price to fit or replace the cracked/faulty part.
Send a letter to the garage with a claim for this amount. If they dont pay up within 7 days you will be contacting VOSA for them to inspect it and see whether it would be upto MOT standards.Censorship Reigns Supreme in Troll City...0 -
An MOT only proves that the vehicle was roadworthy on the day of the test. So it could well pass an MOT on one day and the exhaust fall off the next.
Unfortunately wear and tear items are not covered by garage warranty. You would have to prove the fault was there when you bought it which again would be difficult. A conversation with the person in charge would be your best bet.0 -
As stated it was advisory on MOT certificate that there was a leak on the exhaust system so the fault was there on day of sale. Another garage quoted £120 to fit centre section although chances are the system thats on will be wider than standard so to replace centre section with a standard part would mean replacing the back box as well.
The garage suggested that they would get both parts at trade price which I would have to pay for and they would fit it for free. Very arrogant salesmen, i'll be advising everyone to not buy cars from there.0 -
I guess you read the advisories before purchase?
If you had bought the car knowing the advisories then the offer of the parts at trade price seems fair to me.Google gives you answers use it.........0 -

So it has a full years MOT, did you consider that you may have to replace the exhaust soon? They don't leak for no reason, most often it is because they are ready to fall off.
If you thought you may have to replace it, what is the problem?
Did you ask about it at the time of sale, and consider your options?
Maybe the garage was a bit close to the mark with their description, if it was indeed 'just' roadworthy I don't think you have any recourse.0
