I really don't know - the courts would have to decide this if it got that far - but surely having been served an eviction notice, & the OP having made arrangements to move the problem is between the LA & the LL.

Don't worry about it too much, it's pretty much standard practice these days, it just makes it easier for the LL to get you out should they wish to do so due to problems like not paying rent. If they haven't issue the S21 and you stop paying rent etc, then the process for the LL to get rid of you is pretty long and drawn out and from memory the first step is issuing the S21. If the S21 has already been issued (and there are no real rules as to when an S21 can be issued) then they saved some time. For the S21 to be valid it has to be issued 2 months before the end of the agreement (or something along those lines), so issuing anything after 2 months before the end of your rental period would make the S21 invalid in court which is probably why it expires 2 months before, if that makes sense!0

Nope. Once a landlord has issued a S21 that's it. If the tenant makes arrangements to move based on the S21 the landlord can't just turn round a month later and say "Oh sorry I want you to stay after all". The fact that the S21 is invalid is irrelevant as the tenant isn't challenging it. I suspect there are many tenants evicted by invalid S21s which is fine if the tenant doesn't mind or realise.

When will landlords realise that an S21 is an unequivocal and without reservation notice for the tenant to leave that should be issued with consideration.0 -
