Item damaged in transit

Hi there all,
Hoping to get some advice on here.
I bought a dinner set on Ebay on 16th Dec. It arrived a few days later via courier and unfortunately was smashed to pieces.
I contacted the seller with photos of the damage. I didn't hear back from him for a couple of days but let it go as it was Xmas eve, Xmas day. I got back in contact on the 27th and made it cear that I wanted a refund. He agreed to refund once I took some more photos.
I took about 30 photos of the damage. He then agreed to the refund via paypal.
I received an email from paypal informing me of this refund, however on my PP account it showed as pending until 7th Jan.
Today I received a request from this seller via Ebay to cancel the transaction and the refund is still showing as pending, however the transaction is showing as cancelled. I am very concerned now that the refund has been cancelled.
Can I open up a case now as I am still within the 45 days?
Not sure if I am panicking over nothing.

    I received a refund this morning from paypal.
    Can't believe it took so long for the funds to clear.

    It depends if they have funds in the account if not then it could take days for the funds to get to the account for payment /refund o be made.
    All depends on how they fund the account.

    Glad you got the refund in the end.
    Everything has its beauty but not everyone sees it.

    I am unsure if you are aware, yet the new rules for paypal is beyond a joke.

    If you sell something on ebay - their is a upto 21 day period in which you have to wait to receive payment. Which basicly means that if you are expecting your goods to arrive tomorow for example and the seller has not received payment, legally they can make you wait until the 3 week period i.e until they have received their payment for the actual goods before sending out the goods.

    In your case of smashed in transit, the seller is the one to whom is responsible - even though they may not have enough funds in paypal - paypal hold the money until the buyer i.e yourself is satisfied with the goods and leaves feedback - or sends mail stating fine with goods - then the money is released to the seller.

    Confusing as it may be - in your case all the seller had to do was NOT request photographs even though it does help - but simply refund you via payment i.e direct from their paypal account and click refund -

    Then they together with yourself taken it up with the courier company (the seller being the main complainint) i.e the one to receive the insurance of any parcel being carried by any courier in the UK - They are all insured to a minium and maxium value (legally)

    All you would of had to do was write/email the courier's boss and explain how your item was delivered etc and then provided the photographs (they will legally require these - not the seller). They will then process the seller a refund for what insurance they have chosen (if none it could be as less as £5.00 GBP- £ sterling). Yet the seller will receive at least something back if they have actually refunded you in the first place and you both have to work together.

    Now as for you not being happy with the goods in the first place - DONT bother leaving negative feedback for your seller - and be very wary as if you do ebay WILL remove it anyway and put restrictions on your account - as ebay now removes all negative feedback and lets the scammers get away with fraud. - They also take action on your account if you receive 2 or more refunds for example - if you got refunded on this and then for example jo sent you something and you never received that then jo said they had received it back so refunded you ---- later on a few days maybe a week or so will pass and ebay will just go ahead and take action on your account as they do - for receiving too many refunds and for acting fraudlent even though you are genuine.

    Ebay is all a big scam. - Dont even get me started on them.

    I am pleased you finally received your refund, yet dont keep messaging the seller as they will have you done for harrasment i.e its not related to any ebay transaction.

    It is partly right, actually.

    New sellers have their payments held by Paypal for up to 21 days before they can access them. This applies to your first 3 months of trading. You can get the money quicker by posting on time, using the pre-paid postage facility in Paypal and leaving feedback. Oh, and if your buyer leaves positive feedback.

    If you don't do all these things, you wait 21 days to get your money. If you do, and if your buyer leaves positive feedback, you can get it quicker. There's a lot more to it than that but that's a brief outline.

    I've been selling for 8 years on ebay but recently opened a second selling account for a business venture and have been hit by these rules, but if I use my old personal account, I don't have to wait for my money.

    I currently have just 1 account that I've had for about 10 years, I use it for selling regular lines and all buying and occasional selling of stuff I no longer need.

    It seems a lot of people have a 'business' and a 'private' account.

    What is the main reason people do this? Is this to protect the business account from bad feedback from your mums old ipod that you might sell for her, or something else?

    In this case it is (was) almost certainly caused by the seller not having enough funds and the refund was settled by e cheque. Nothing to do with the 21 day holding period.

    The courier has nothing to do with the buyer,it is down to the seller to refund the buyer and then see if they can claim from the courier.

    I think that Ebay say that if you make items for sale, or are selling new items exclusively, then you must register as a seller. Therefore, as I make bespoke items for my business, I have a business account. Apart from anything else, it makes my year end accounts a bit easier to do.

    I keep my personal account for selling off things that I find in the back of the wardrobe, old books etc and things that aren't related to my business.

    Private accounts can get the free 99p listings and Can use the free listing weekends, business accounts cannot.

    It therefore seems like a good idea that if you have truly private items to sell to do them on a private account rather than pay listing fees on your business account. I sell manly on my business account but will use my private one to get rid of unwanted things I have in the house and which I can list for free on my private account
