Stalling credit card companies

Can anyone provide any insight as to what should be the next stage with my credit card charges process.
1. Got a letter back from Capital One after demanding my charges back saying' they are looking into it and will have an answer within four weeks'. Do i wait the four weeks or do i send a letter back requesting it back now or go straight to the court proceedings?
2. RBS and Citicards still haven't responded to my request to provide me with my statements (it will be 14 days tomorrow 27/4). RBS had the cheek to have already cashed my £10 cheque but as yet no statements.
Are they stalling so as to wait for the OFT probe that i heard on the news this morning?

1. If it was the Letter Before Action (LBA) they replied to then you can now proceed to the court stage. You dont have to wait their 4 weeks, this is their timescale for complaints and doesnt apply to this process. If it was the first letter they replied to send the LBA now adding interest.
2. They have 40 days to respond to this request not 14.

I'm thinking i'm going to send them the second letter advising of intenion of court action as i believe 4 weeks is their way of stalling and it's not the response i wanted, therefore not a satisfactory response.
I'm interested to see if Citicards and RBS are going to wait the full 40 days before sending my statements to me.
