Faulty goods-Buy it Now-4 months old- seller says contact manufacturer!

Hi, first time post..wonder if anyone can advise me on a watch which isn't working, and strap's discoloured, after less than 4 months; It was a " buy it now" purchase, which I believe means distant selling rules apply. I've exchanged a number of messages thru ebay,asking for a refund,the seller is telling me to contact manufacturer ( somewhere in China...). I'm worried if I use ebays resolution centre, they'll back the seller, and I wont have recourse to legal action.Can anyone advise me where I stand legally and also should I get ebay involved? Thanks in advance.

    After 7 days, it's the Sale of Goods Act that gives you rights against the seller if they are trading as a business and the item was new.

    The law only says you have a 'reasonable' time to reject the goods and get refunded, rather than a repair/replacement.

    Is 4 months 'reasonable' for a Chinese watch? Depends on how much you paid, otherwise you may have to accept a replacement.
