Cancelling DFS order (not signed finance agreement)

I placed an order with DFS on the phone and they sent me finance details to sign and return but I've not signed or returned them.
Without going into too much detail, circumstances have changed and I needed to remove an item from the order.

I phoned up and they said they can't change the order but they can cancel it and reorder it. I said I'd think about it as this meant waiting another 6 weeks. I decided to just cancel it outright but when I phoned back they said I can't but I said I wouldn't pay for it and they said they'll get a manager to look into it and call me back in a couple of days.

I've only paid deposit so far and I've not signed or returned the finance documents so I'm expecting to lose deposit but order be cancelled.

Anyone had a similar experience? I did look around the forums but they were usually pertaining to cases where the finance forms had been signed and returned.

    I've not had any dealings with DFS, however if you've not signed any finance agreements and have just given a deposit then you should be able to to just cancel the order.
    Whether or not you can get a refund of the deposit depends entirely on the DFS small print on deposits. I would imagine it says something like non refundable.

    Opinions here (including mine), if based on scant information and speculation, will be useless to you.

    What does the contract documentation actually say regarding cancellation? Thats the only thing you should be concerning yourself with. By all means ask for assistance with interpreting a specific clause if you need it but bear in mind that the only way of reading a particular clause in a contract is in the context of the whole document.

    You will not loose your deposit- well they will "save" it for you to put towards another purchase in the future, but you will not get it refunded.

    I agree with Keystone - the contract is the crucial thing.

    However, one further point. You appear to be merging the contract to order the sofa, and the contract for the finance. Whilst they are related, it is possible to have irrevocably ordered the sofa - and be committed to that purchase - and not yet have gone through a decision regarding how you pay for it.
  • Thanks for the reply guys. It's pretty complicated but here's the story:

    My girlfriend ordered the sofas on her card and in her name as she was meant to be moving in with me as I've just bought my first house.

    I decided I didn't want to live with her so sacked her off and got the sofas transferred to my name with the finance option (originally were going to pay outright).

    I got a letter through with a sales contract and finance contract. It says I need to sign both and return them, which I haven't done. As far as I'm concerned, I'm not bound to buy these sofas as I haven't signed the sales contract or the finance contract. A manager called and said he was going to look into whether I can cancel them or not so I should hear back today. I don't think DFS have a leg to stand on though; I'm not paying for them no matter what- rightly or wrongly.

    If your (ex?) g/f ordered them in her name and with her credit card then surely it's for her to cancel if she wishes?

    I got the order transferred over to my name and they sent out a new sales contract in my name along with the finance forms.

    I called DFS this morning and the girl on the phone confirmed the orders have been cancelled but a manager will call me later to discuss it. I assume he'll just be telling me what they're going to do with my deposit. It's a relief though, got enough on my plate with buying the new house.
