CSA help

My ex has paid maintenance every month with no problems. My daughter turns 18 in June. She is in her final year of sixth form and so leaves school in July. She hopefully will then go to Uni in Sept/Oct time. My ex is only paying maintenance until her 18th birthday, something he decided, it was not discussed with me. I believed he had to pay until Child Benefit stopped, which would have been September but after asking on MSE forums, it seems this is not the law, just something the CSA go by.
My question is, if I go to the CSA to ask for payment til September, will they just look at this, or will they rake over the last 13 years payments? I have no problem with previous payments I just think he should pay while she is still classed as in education.
Any help appreciated.

    I think in most cases CSA is paid while the child is in full time education. I think you need to speak to the CSA to clarify this or perhaps your solicitor - wasnt anything agreed during the divorce?

    You would be best asking on the Child Support board.

    AFAIK if you pay through the CSA the new rule is CSA payable until 20 if in full time education. I think this new rule was in December, if you ask on there you will get replies from those in the know.

    Child maintenance is financial support that helps towards a child’s everyday living costs when the parents have separated.
    It’s for children who are either:
    • under 16
    • under 20 and in full-time education (but not higher than A-Level or equivalent)

    I would assume from that, at best, you'd get payments until she leaves school in July, so only an additional month.
  • Ask the school when she is taken "off roll". Ours are kept on until the day after A level results day, so mid- August. So technically in FT education until then. Other schools take them off roll the day after their final exam to stop them coming into school and causing havoc. That could be June. Others remain until the new year begins - early september. Whatever that date is, that is the date he can stop paying you. What he should really do at that point is give DD an allowance payable to her directly to help her through Uni, but that is between DD and your Ex.
